| 摘 要： | 近年来，我国发生了许多高等学校和学生之间的法律纠纷。随着大学生的法律意识的不断增强．大部分诉至法院，以期通过法律诉讼途径解决。这些案件引起了法学界和社会的广泛关注。该文认为引起这些纠纷的主要原因在于高校与学生之间的法律关系，高校内部规则的法律性质不够明确。而对这一问题的解决，将有助于明晰高校与学生之问的法律关系，稳定高校的教学管理秩序。

| Abstract: | Around the country had many legal disputes between universities and students in recent years, university student＇s legal awareness also enhanced incessantly, the majority sued to the court in order to solve through law litigation. These cases caused the widespread attention of law circle and society. The main reasons of these disputes lay in indefinite legal rela- tionship between the universities and students. But the solution of these questions will be helpful to clarify legal relationship between the universities and students, stabilize the university＇s teaching management order. |
