| 摘 要： | “人肉搜索”是最近几年出现的一种新的网络现象。但是由于未能区分事实层面的“人肉搜索”与规范意义上的“人肉搜索”，导致当前人们对“人肉搜索”的认识存在诸多误区。作为法律规制对象的应当是“人肉搜索”中的具体行为特别是搜索后行为而不是“人肉搜索”本身，将“人肉搜索”在立法上予以规定是一个伪命题。“人肉搜索”是否法律化，从根本上来说是一个司法问题，而不是立法问题。我国现有的法律体系完全可以解决“人肉搜索”的问题。
