| 摘 要： | 唐代继承儒家德主刑辅礼法并用的思想。《文苑英华》所收唐代判文以涉及儒家“五礼”内容判文种类最多，判文涉及继承、孝道、丧礼、官制、军事并民事诸多内容，均被纳入“礼治”范畴，依礼审视甚或依礼判决，“礼”字出现次数不可胜数，行文也显现了司法审判对“礼”的重视和依赖。

| Abstract: | It is inherited in the Tang Dynasty that Confucian ideas of supplementing punishment to benevolence and uniting ritual and law, the most types of decision instrument of the Tang Dynasty related to ＂five kinds of rituals＂ are embodied in Wen Wuan Ying Hua. Involving inheritance, filial piety, funeral, official system, military and civil affairs, but these documents are fitted into ritualruling category and examined and adjudged according to ritual, the usage of character ＂ritual＂ is innumerable and the style reflects ＂ritual＂ emphasized and guided in judicial trial |
