| 摘 要： | 中国法制文明渊远流长，在传统中国法律发生发展的历史长河中，浸透着浓郁的儒家文化思想，显现东方文化特有的精神气质，其中“礼刑结合”、“德主刑辅”是德治与法治并重的法治思想渊源。中国法制演变的逻辑，为今天我们加强依法治国和以德治国相结合，构建社会主义和谐社会提供宝贵的历史鉴借。
