| 摘 要： | 非法转让、倒卖土地使用权罪的客观方面表现为非法转让、倒卖土地使用权,情节严重的行为。从司法实务要求的视角出发,如何认定该罪客观方面是一个司法难点。因此,进一步完善非法转让、倒卖土地使用权罪客观方面,明确界定本罪之成立范围,已成为司法实践中正确认定此类犯罪的关键一环。

| Abstract: | The objective aspects of illegally transferring or reselling the right for land use crime is illegally transfers or resells the right for land use in violation of laws or regulations on land administration.From the real meaning,there is a dispute on how to interpret its the objective aspects;from the essential meaning,it need be modified because of its defects;There are some disputant items about how to confine its objective aspects or in criminal proceedings.Therefore,how to act according to consummate the objective aspects of illegally transferring or reselling the right for land use crime,and make clear about the scope of establishment of this crime,which has become a key link in cognizance of this kind of crime in the judicial practice. |
