| 摘 要： | 在我国《信托法》刚刚颁布实施之际,文章从比较法的角度,就受托人的亲自处理信托事务的义务及其例外展开研究,阐述了受托人将信托事务委托代理人的合理性和限制条件,并分析了在此情况下受托人与代理人的责任分配和对于其同受托人的特殊规则。最后结合我国的信托立法,分析了我国相关法条的特色和不足。

| Abstract: | On the occassion of the issue of The Law of Trusts,the paper makes a comparative study of the obligations that a trustee has in dealing with trust matters himself and its exceptions.It explains the resonableness and limited conditions when a trustee entrusts trust matters to an agent.And it analyzes the responsibility all ocation on the part of the trustee and the agent in this case.At last,the paper analyzes the features and deficiencies of corresponding legal provisions by virtue of our country's trust legislation. |
