| 摘 要： | 道德以其自律性要求维持社会的稳定,但其局限性极大。在商品经济社会,法律已成为调节人们之间各种利益关系,处理社会冲突,营造和巩固稳定的社会秩序的决定性力量。民法基本原则在坚持法律的他律性的同时,吸收了道德的自律性规范,通过在平等主体之间构筑公平、诚信、平等、自愿的社会基础,夯实社会的稳定秩序,实现其构建和谐社会的功能和社会价值,体现了民法基本原则追求和谐的社会价值取向。

| Abstract: | Morality requires maintaining the social stability by means of its automaticity but its limitations are clear.In the society of commodity economy,the laws form the determining force of adjusting people's interest relationships,dealing with the social conflicts and creating and consolidating the stable social orders.The basic principles of the Civil Law stick to the quality of other-discipline,absorbing the norms of moral self-discipline and on the basis of constructing the social basis of justice,honesty,equality and willingness between equal subjects,we can compact the stable orders of the society and realize the social function and value of creating a harmonious society,which embody the social value orientation of the basic principles of the Civil Law. |
