摘    要:随着教师聘任制的实行,传统的教师权力救济制度由于高校与教师之间的法律关系不明以及特别权力关系理论的滞后致使学校内部管理权力出现法治"真空"。可以借鉴国外的做法,建立一种适合我国国情的具有公平性和可操作性的教育仲裁制度,在保证大学自治的前提下,既能保护教师的合法权益,又能发挥国家教育主管部门的监督管理与指导效能。

Abstract:Along with the exertion of the system of teacher employment under contract in higher institutions,the legal relationship between the institutions and their employed teachers becomes ambiguous,and the specialty power relationship theory lags behind practice.Thus,for the conventional relief systems of teachers' power,there exits a legal "vacuum" in institutions' interior administration power.With reference to international practice,this paper presents a fair and practicable educational arbitration system with Chinese characteristics.Under the system and on the premise of guaranteeing the autonomy of institutions,the legal rights of teachers could be well protected while the national education administration departments could perform their functions of supervision and guidance.
