| 摘 要： | 三农问题的核心是农民问题,本文认为农民问题的本质是农民权益问题,而农民权益问题的实质是农民的人权问题。2004年宪法修正案将尊重和保障人权纳入国家的根本大法,为农民权益保障提供了宪法依据。尊重和保护农民权益既符合人权入宪的价值取向,亦是构建社会主义和谐社会的题中应有之义。保护农民权益,构建和谐社会,对党的执政能力和政府管理水平提出了新的时代要求。从现行的立法状况来看,我国的农民权益遭遇一定程度的漠视和侵犯。正视农民权益缺失的现状,探寻其原因,并采取行之有效的对策措施乃是当务之急。
