| 摘 要： | 犯罪的时候不满18周岁的未成年犯不适用死刑；刑法第49条未排除未成年犯适用无期徒刑的可能，而根据刑法第17条第3款“应当从轻或者减轻处罚”的规定，未成年犯则不宜适用无期徒刑；未成年犯能够适用管制刑，但在实践中应当严格加以限制。
