| 摘 要： | 在中国法律史的研究中,单一的考证或社会史方法只能研究古代法外在的“量”与“效”,无法深究内在之“质”与“因”,而规范分析的方法,虽能够深入研究古代法的内在机理,却存在“以今日之见揣度前人”的潜在风险.为避免这种风险,应建立一个由命题出发的概念坐标系,综合运用考证、社会史、规范分析的方法,以在古今中西不同概念、思想、制度体系之间展开平等的“相互对释”.这需要研究者对所比较的对象有同等深度的认识和学术根底,且在历史观和方法论上有深思熟虑的修养和整体系统的眼光.

| Abstract: | In the Chinese legal history study,textual research and social historic method explore external "quantity" and "efficiency" of ancient law,but they can not get into the internal "quality" and "reason" study.The normative analysis can deeply study the inner mechanism of ancient law,but it contains a potential risk of seeing those previous by us today′s thoughts.To avoid this risk,we should establish a concept coordinates system start by the proposition angle,multiple use these methods of textual research,social history,and normative analysis,so that we can establish an "inter-explanation" way among different concepts,ideals and institution systems at all times and in all countries.This "inter-explanation" needs researchers have equal deeply understand and academic foundation at these research objects,and have thoughtful training and systematic insight over the field of history and methodology. |
