| 摘 要： | 二战后,世界范围内死刑在逐步被限制并走向废止的同时,由于世界各国面临毒品犯罪的严峻形势,从上个世纪80年代至2000年的20年间,世界上毒品犯罪规定死刑国家的数量却出现了明显增加。当前,虽仍可认为"国际法并未完全禁止使用死刑",但死刑的废除是一个不可阻挡的趋势。毒品犯罪死刑废除并未得到我国当前立法的支持,但鉴于运输毒品罪的特殊地位和其社会危害性,立法上或司法上先行废除其死刑的适用,对于减少我国死刑的适用、推进我国毒品犯罪死刑的废除具有现实意义。

| Abstract: | After World War II,the death penalty in the whole world was progressively restricted and came to abolish.However,because the world was confronted with the serious situation that drug-related crimes increased,from the period of 1980′s to 2000,the number of countries that the death penalty was provided for drug-related crimes went up clearly.Currently,although we can still consider "international law does not completely prohibit the use of the death penalty," but the abolition of the death penalty is an irresistible trend.The abolition of death penalty for drug-related crimes was not supported by China′s latest legislation.But given the special status of the crime of transportation of drugs and their social harm,abolition of the death penalty for transportation of drug crime in the legislation or judicial practice has a practical significance for our country to reduce the application of the death penalty and to abolish the death penalty for drug-related crimes. |
