| 摘 要： | 过错原则是现代侵权理论的基本归责原则,曾为现代经济发展提供了法律理论依据。但随着社会的发展,判断过错的标准逐渐发生了变化,由主观标准向客观标准转化。在实践中应当以客观标准为原则,辅之以主观标准的判断方法。
