| 摘 要： | 国家对其权属范围内的一切事物享有统治权和管理权,可见,统治权和管理权是国家主权概念中"权力"的内涵。从国家与法的产生来看,国家主权离不开法律。因此,应当从法律角度解读国家主权的本质属性:国家主权是法律下主权;国家主权是权利和义务的对立统一体和平衡体;国家主权权力行为只不过是国家依法行使和履行法律上权利、义务的方式和途径。
