| 摘 要： | 农村土地集体所有权是特殊时代下强制性制度变迁的政治产物,创制之初就与法律逻辑没有多大关系,造成目前农村土地集体所权制度运行中的诸多问题。当前的农村土地集体所有权制度改革是重新调整农村土地利益分配的诱致性与强制性并重的制度变迁过程,法律改革的核心在于在集体所有权的框架下理清农民集体的法律内涵、通过对征地制度和农村建设使用权制度进行调整以实现集体所有权在经济利益、平衡集体所有权与集体成员土地使用权的关系及完善农村土地登记制度。

| Abstract: | The collective ownership of rural land is the political product of compulsive institutional changes in the unconventional circumstances. Its establishment, being rarely related to legal logics, is the reason for many problems which occur in its operation today. The current reform on collective ownership of rural land is a process of both induced and compulsive institutional change, which is meant to redistribute land interest. The core issues in the legal reform are to ratify the legal meanings of＂farmers as a whole＂ within the collective ownership system, materialize economic benefits by adjusting land requisition rules and the rules for use of rural construction land, balance the relationship between collective ownership and individual right for using the land and set up the land registration system. |
