| 摘 要： | 从法律关系的内容出发,国际法现阶段还应以义务为本位。从理论上分析,国际法基本原则体现了义务本位;国际强行法体现了义务本位;国际法主体内涵体现了义务本位;国家主权体现了义务本位。在国际法实践中,国际法院有关案例、海洋法、环境保护法、WTO法等都体现了义务本位。
