| 摘 要： | 针对当前学界以婚姻法之属于民法、私法，作为婚姻法适用私法自治原则根据的现象，运用比较的历史的方法，在对婚姻法在中外法律体系中地位的历史变迁及其特征进行考察后，认为，婚姻法在理论上以及立法上是否归属于民法，与婚姻法是否贯彻意思自治原则不存在必然的联系，并进一步厘清了私法、民法以及私法自治等基本概念和提法，提出，婚姻法之回归民法，在考证清楚其理论源流权衡利弊之前应该缓行。

| Abstract: | The academic circle usually subordinates marriage and family law to civil law or private law and adjusts it to the principle of autonomy of private law. However, with the result of historical investigation of the position and features of it in the law system, readers can find that there is no necessary relationship between the legislation of it and its subordination to the civil law as well as the principle of autonomy. The concepts of private law, civil law and autonomy of private law require further chrification before the subordination of marriage and family law to the civil law. |
