| 摘 要： | 我国正在起草新的婚姻家庭法，离婚的法定理由将有重大修改，在确定离婚理由的立法过程中，无过错离婚成为一种趋势，无过错离错制度在美国大部分州已经得到确立，我国婚姻家庭法应确立以无过错离婚为主，过昏离婚为辅的原则，因为它是符合婚姻法的本质的。

| Abstract: | China has been drafting a new marriage and family law,and will revise a lot about statuated divorce causes.During the legislation,no fault divorce will be the trend.It has been estiblished in most states of U.S.A.Therefore,by anylysing the history and results of no fault divorce in America,the author studies the statuted divorce causes that will be set up in the future marriage and family law. |
