| 摘 要： | 认为在无独立请求权第三人的确认标准中，所谓法律上的利害关系在内容上应当不仅包括责任义务还包含有权利及权利义务的交叉。通过分析，导出权利型无独立请求权第三人的概念。并进一步探讨这种无独立请求权第三人的确定条件，参诉方式，诉论权利等制度上的特点。

| Abstract: | It is considered that in the definite standard of Non-independent requirements of the third person, on the content of so called laws which have some relationship of harms and benefits should not include the obligations but also include the interaction of the power and his power or obligations. Through analysis, we can introduce out the concepts of power-type and non-independent requirements for the third individual. And we can also probe the determined condition of the third person of this type and its way of accusing or the specialty of its accusing power. |
