| 摘 要： | 1950年新中国第一部《婚姻法》所确立的婚姻财产制是一般共同制,夫妻共同财产的范围极为广泛;1980年《婚姻法》排除了1950年《婚姻法》的夫妻婚前财产共同制;2001年修正的《婚姻法》及其后的三个司法解释逐步完成了夫妻共同财产制向分别财产制的价值转向。我国现行婚姻法律制度对夫妻分别财产制的倚重有其深刻的经济根源,也体现了司法实践的诉求,对我国婚姻家庭关系的前景有着特殊的影响。

On the Historical Evolution and Value Turn of Matrimonial Property System of China |

| Abstract: | The matrimonial property system established in the first "Marriage Law" issued in 1950 refers to a common system and the scope of property is very wide.And the "Matrimonial Law " in 1980 excludes this common system,and the revised "Matrimonial Law" in 2001 and its late judicial interpretations gradually finished the transition from common property to separate property.The over-reliance of the current matrimonial property system upon the matrimonial property system has its own deep economic origin and reveals the resort to judicial practice,which exerts a particular influence upon the prospect of relation between marriage and family in China. |
