| 摘 要： | 在司法实践中,鉴定结论往往是认定案件事实的关键依据。但当下鉴定文书良莠不齐,重复鉴定、矛盾鉴定频出,极大地损害了审判的公正性。究其原因,主要在于缺乏科学、恰当的司法鉴定管理机制。为此,除了积极推动立法进程,为司法鉴定管理工作建立制度保障外,更要加强法院的职权监管,发挥庭审质证审查功能,深化咨询、审核功能,从而有效控制鉴定事实,维护司法公正。

| Abstract: | In the judicial practice,Judicial Identification is the key point to cognize the fact.At present,the poor forensic service quality such as re-identification and wrong identification,has obstructed fair trial greatly,the main reason of which,is lack of a perfect management system.In order to achieve justice and maintain the fact,on one hand,legislative process has to be promoted to provide an institutional guarantee.On the other hand,judicial supervision also has to be strengthened by intensifying cross-examination and advisory features. |
