| 摘 要： | 集体土地作为农村最重要的生产要素,其资产属性日益彰显,而已有的法律制度与其资产属性呈弱相关,与中央政府对农业的支持政策呈强相关,这就凸现其法律制度的滞后。深化集体土地法律制度改革总体取向应是在土地资源的利用、经济发展的速度、自然生态环境的保护等综合决策的理念下,来完善集体土地法律、法规建设,使其为农业生产力的组织结构调整保驾护航,为创新集体土地市场调节机制夯实理论基础。其中土地承包经营权价值流转是土地承包制的一种衍生制度,依法流转是健全集体土地法律制度的重要内容。

| Abstract: | As the most important product element in countryside,the assets property of collective land is increasing and has something to do with the weakness of current legal system and the strength of central government＇s policy support to agriculture,which indicates the lag of legal system.The general trend of deepening legal system reform of collective land should perfect the legal and statute construction under the ideas of land use,speed of economic development,natural ecological environment protection and other synthetical decision,and make it protect organization and structure adjustment of agricultural productivity and tamp the theoretical basis for creating market adjustment system of collective land.Among it,value flow of land contractual management right is a kind of ramification system of land contractual system,and legal flow is the important content of perfecting legal system of collective land. |
