| 摘 要： | 知识产权的目的是激励科技创新,但是过度保护知识产权又可能会抑制科技创新发展。知识产权表现为一种法定垄断状态。在知识产权许可协议的谈判过程中,掌握技术标准中知识产权的权利人从事限制竞争的行为,可能导致合法的垄断转化成反垄断法所关注的经济垄断。通过分析技术标准中知识产权人拒绝许可行为及典型案例,说明了采取一定的反垄断法规制,可以减少因知识产权过度保护导致的科技创新垄断效应,改善科技创新生态环境,进一步提升国家创新发展空间。

| Abstract: | The purpose of intellectual property rights is to stimulate scientific and technological innovation,but excessive protection of intellectual property rights may inhibit the development of scientific and technological innovation.Intellectual property is a state of legal monopoly.Through the technical standards formed by intellectual property,intellectual property owners engage in the behavior of restricting competition during the negotiation of intellectual property license agreement.Under certain conditions,such legal monopoly right may be transformed into the economic monopoly concerned by anti-monopoly law.By analyzing the behavior of intellectual property owners’refusal to license and typical cases in technical standards,it is illustrated that adopting certain anti-monopoly law regulation can reduce the monopoly effect of scientific and technological innovation caused by excessive protection of intellectual property rights,improve the ecological environment of scientific and technological innovation,and further enhance the space of national innovation development. |
