| 摘 要： | 《周易》分为经、传两部分，两者产生的时间不同，所反映的思想观念也不一样。文章对《讼卦》进行分析，明确了《周易》产生时期社会政治和经济利益剧烈变化所带来的广泛的诉讼行为是《讼卦》进入《周易》的社会基础，并根据＂以经观经，以传观传＂的原则，证明中国人＂贱讼＂意识的产生是儒家形成以后的事，在儒家产生之前并不存在。

| Abstract: | Book of change includes two parts：Philosophy and Biography. They, written in different times, reflect diverse thoughts. Divinatory Lawsuit is analyzed in this paper. It is claimed that the dramatic change of social politics and economy, when Book of Change was composed,is the social foundation for the composition of Divinatory Lawsuit. With the principle of close analysis of Philosophy and biography, it is proved that the idea of ＂distaining lawsuit＂ was developed after Confucianism. |
