| 摘 要： | 随着城市化进程加快,征地过程中侵害农民土地权利的现象十分普遍。究其原因在于：农村集体土地产权模糊、缺位和不完整;现行征地制度、政策存在的弊端;计划经济时期形成的二元经济结构至今尚存;土地管理体制和现行已有的方面的各种法律还不足以保护农民的合法权益;农民对土地珍惜程度下降等。因此,必须有针对性地制定保护农民土地权利的政策、法律,为解决“三农”问题提供依据有一定的意义。

| Abstract: | During the rapid urbanization, a phenomenon of frequent infringement of the peasants' right on their land appears in land-purchase. The present thesis discusses and analyses the cause of the infringement of the peasants' right on their land from several aspects: the lack, non-integral and vague right of the collective land, the malpractice of the present policy in land-purchase, the existence of the two-center economic structure formed under the planned-economy, the weak security of the present existing laws and regulations for protecting the rights and interests of the peasants, and the decreasing valuation of the peasants' attitude towards land. It is significant to make some policies, laws and regulations to purposefully protect peasants' rights on their land so as to provide a sound basis for solving the "Three Peasant-related Problems". |
