| 摘 要： | 20世纪80年代以来,我国农村人口城市化的序幕已经拉开。在这个历史进程中,我国农民工的市民化进程伴随着工业化、城市化、市场化而发展,形成了有中国特色的"农民工市民化"命题。实现农民工市民化的过程,遇到了来自我国传统的城乡二元治理结构的重重阻碍。从农民工市民化的含义及其法制需求入手,沿着农民工从农村退出法律制度、农民工城市进入法律制度、农民工融入城市法律制度这条逻辑主线,详细论述了农民工市民化进程中的法律制度建设问题,以求以法治的手段为农民工市民化这一历史进程提供法律制度保障。
