我国行政强制执行权分配的模式与基本原则

摘    要:行政强制执行权由执行裁断权、执行决定权和执行实施权三个下位阶的权力组成,同时,考虑到现代分权理论和行政管理对公正与效率的追求,行政强制执行权应当在协调人权保障和提高行政效率的关系中重新进行分配:即一般情况下,做出具体行政行为的行政机关行使行政强制执行权的全部权能;对公民、组织影响较大的强制执行,由人民法院对作为执行依据的具体行政行为的合法性等内容进行审查,具体实施则由做出原具体行政行为的行政机关负责。

Abstract:Administrative enforcement consists of executive judicatory power, executive decision power, and executive practice power. For justice and efficiency pursued by modern separation of powers and administrative management, this paper proposes that administrative enforcement power should be re-allocated while protecting human right and improving administration efficiency, which means, in general cases, the agency of the concrete action should have the right to exercise administrative enforcement, while in cases of greater influence on the citizens or organizations the people's court should inspect the legality of the agency's action though the action should be taken charge of by the agency that conduct the action.
