| 摘 要： | 持有行为是属于作为,还是不作为,这是目前争论较多的问题.有学者认为它属于作为;有学者认为它属于不作为;有学者认为它既可能是作为,也可以是不作为;还有学者认为它是独立的第三种犯罪行为形态,既不是作为,也不是不作为.笔者支持第四种观点,即独立说.在本文中,笔者对前三种观点进行了质疑和批评,并从六个层面对独立说展开阐述.

| Abstract: | There are four major controversial opinions with respect to the nature of possession.Some believe that it belongs to action,some think that it belongs to omission,some believe it just depends,others think possession is a third action pattern,and it does not belong to action nor omission.In this article,the author is in favor of the fourth opinion,and four kinds of opinions will be introduced and discussed. |
