| 摘 要： | 刑事诉讼中被告人认罪具有极其重要的价值和意义。应准确界定认罪的标准及其构成要件,充分认识被告人认罪确认的复杂性,逐渐树立认罪应当得到明确量刑回报的司法理念。为顺应刑事诉讼全球化的发展趋势,我国刑事诉讼应当在借鉴英美法系国家罪状认否程序的基础上,设立独立的被告人认罪确认程序,以推动我国刑事司法改革朝着公正与效率兼顾的价值目标不断迈进。

| Abstract: | The peccavi of the accused and their affirmance in the criminal lawsuit has very important value and significance.The standard and its construction of the peccavi should be clearly defined with the sufficient recognition of complexity of the affirmance and be sure that the judicatory conception that peccavi should be given defined criminal measurement return.To follow the developing tendency of the criminal lawsuit globalization,our criminal lawsuit should be based on the use for reference of the facts about a crime recognition procedure of Britain,America and France to set up independent peccavi defining procedure to promote the reform of the criminal judicatory in our country towards the value target considering both fairness and efficiency.This article makes an approach on the issues mentioned above. |
