| 摘 要： | 法律与道德的关系一直是法学界争论的焦点问题 ,西方两大法学派对此针锋相对。在依法治国的新时期 ,我们要站在马克思主义的立场上 ,从静态和动态的角度对二者关系进行全面、正确的分析 ;并在法治实践中 ,谨防“法律万能论”和“泛道德主义”,坚持两手抓 ,实现法制建设和道德建设的协调统一

| Abstract: | The relationship between morality and law has been the debating focus of law circle. There are two western law schools who are diametrically opposed to each other on this issue. In the new period of governing country by law, we should stand in the position of Marxism, and correctly and comprehensively analyze the relationship dynamically and statically meanwhile,in practice,we should beware of "the universal theory of law" and "the general doctrine of morality", and pay close attention to law construction as well as morality construction. Only in this way can we realize harmony between them. |
