| 摘 要： | 法律冲突是实践中普遍存在的，也是一个永恒的问题，但是对于行政法律冲突学术界研究甚少。即使有研究，也主要聚焦在不同位阶的行政法律冲突、新旧行政法律冲突、一般法与特别法之间的冲突上，很少研究互不包容的两个行政区域所制定的法律、规章之间的冲突。但是实践中又大量存在，因此近年来学术界提出了“区际行政法律冲突”与“区域行政法律冲突”两个新概念，作者在比较二者的基础上提出了适用实体法、冲突法、国际条约、行政合作、违宪审查等不同途径解决两种行政法律冲突的方法，以期能够对实践中正确解决行政法律冲突及完善相关的立法有所裨益。

| Abstract: | In practice, conflict of laws is widespread and it ＇s a permanent problem. However, in the academic community, we pay little attention to the research of conflict between administrative laws. And our research mainly focus on the conflict between administrative laws of different ranks, of the new and the old, of general laws and special laws, rarely respect to the conflict between regional laws and regulations made by two different divisions which are not inclusive each other. However, in practice there is also a large number, so the academic community in recent years of ＂administrative inter - district conflict of laws＂ and ＂conflict between administrative laws of different divisions ＂ of the two new concepts, the author suggested to apply the substantive law, the law of the conflict, International treaties, administrative co - operation and judicial rewiew to settle these two administrative law conflicts based on the comparison of them, in order to settle the conflict of the administrative law in practice correctly and try to give us some help to the related legislation. |
