| 摘 要： | 近几年，法院调解重新受到重视，有再度兴盛之势。笔者认为法院调解“复兴”的原因有三个方面：一是构建社会主义和谐社会的需要，二是受国外纠纷解决方式变化的“大气候”影响，三是调解的比较优势。调解的“复兴”说明了调解这一纠纷解决机制的正当性和存在的合理性，法院调解必将在我国获得进一步的发展。
