| 摘 要： | DVD专利案给中国DVD企业带来了难以弥补的损失,对于国外这种联营式的专利垄断行为,中国企业难以利用本国的法律来维权。因此文章从欧盟的反垄断法、美国反托拉斯法以及WTO的竞争政策三个方面着手,讨论了垄断行为的规制方法。同时对于中国制定反垄断法的必要性从市场经济的要求和国内外的形式两方面进行了分析,并对中国反垄断法的送审稿的内容作了论述。

| Abstract: | The DVD patent suit has brought a big loss for China's DVD enterprises.Regarding this kind of patent pool monopoly behavior,Chinese enterprises are unable to use our own law to protect the right.Therefore the article takes three aspects,European Union's anti-monopoly law,American Anti-trust laws as well as the WTO competition policy into consideration to discusse how to regulate the monopoly behavior.Meanwhile analyzes the necessity of legislation of anti-monopoly law in China and the elaboration to the revised Chinese anti-monopoly draft text. |
