| 摘 要： | 作为来自社会生活本身的产物,民事法益包含民事社会生活利益和民事法律应保护性两个要素。民事法益具有仅得民事法律消极或间接保护的天生弱性,使得民事法益游离于民事权利体系之外,难以得到民事法律的＂眷顾＂。加强民事法益的保护正是为了克服民事法益自身这一与生俱来的弱性。以民事法益之属性为切入点,探求民事法益保护之蹊径,正是民事法益属性的本质要求。

| Abstract: | As a product of people＇s society life,civil legal interests include civil society life interests and civil law should protect the interests two elements.Civil legal interests has a weak nature of innate which is only had the civil law＇s passive or indirect protection,make it outside of the Civil Rights System,hard to obtain civil law＇s protect.Strengthen the protection of civil legal interests just in order to overcome this weak nature.Make the property of the civil legal interests as an entry point,explore the paths to protect the civil legal interests,which is just the essential requirements of the property of the civil legal interests. |
