| 摘 要： | 随着国际交往的日益频繁，民间文学艺术作品潜在的文化价值和日益凸现的商业价值使其权利纠纷日益增多，民间文学艺术作品的法律保护问题也越来越为国际、国内社会所关注。但我国现行的法律制度并没有对民间文学艺术作品的保护作出详尽的规定，因此如何对我国的民间文学艺术作品进行有效地保护已成为我国立法亟待解决的问题。文章分析民间文学艺术作品法律保护的现状，揭示我国民间文学艺术作品保护存在的问题，以期有助于我国民间文学艺术作品保护体系的构建。

| Abstract: | With the increase of international exchanges,the potential cultural values and the increasingly apparent commercial values of the folk literature and art works cause the increase of the rights dispute of folklore. The legal protection of folklore is getting more and more international and domestic social concerns.However,the present legal system of civil protection of folklore has no detailed provisions.So,it becomes an urgent problem in legislation on how to protect folklore effectively.This paper begins with analyzing the status of the protection of folklore,reveals the existing problems of the protection of the folklore,and hopes to help the construction of the protection system of the folklore. |
