| 摘 要： | 不同国家法律对未成年人缔约能力规定有所不同,我国《合同法》对未成年人缔约能力和缔约效力方面的规定,从文义上分析,存在不全面和欠明确等不足,容易使人产生误解,不利于法律适用。试从完善我国《合同法》第47条有关规定着手提出自己观点供司法参考。

| Abstract: | The legal stipulations for minor contract-making capacity differ from nation to nation.Analyzing from the context,the paper found that the stipulations of Chinese contract law for minor contract-making capacity has some obvious deficiencies,such as slurred and ambiguity in the expression of the meanings which easily leads to the misunderstanding.The article attempts to discuss how to improve the Article 47 in the Chinese Contract Law. |
