| 摘 要： | 关于所谓的"片面共犯",国内外刑法理论和实践存在激烈争议。基于"犯罪共同说"的立场和我国大陆刑事立法,不能承认"片面共犯"。所谓"片面的共同正犯"是直接正犯与间接正犯的竞合;其他种类的"片面共犯"实质上是间接正犯。

| Abstract: | Quite different views are held in respect of the so-called "one-sided accomplice" both in China and abroad.Based on the standpoint of the theory of the criminal common and the legislation in China mainland,the notion of "one-sided accomplice" should not be accepted.The so-called "one-sided joint principal offender" is the coincidence of the direct principal offender and the indirect principal offender while other types of the so-called "one-sided accomplice" are actually the indirect principal offenders in nature. |
