| 摘 要： | 人肉搜索引起的社会评价争议是网络信息开放、言论自由与网络环境下公民私权利之保护的冲突与平衡,是社会中其他相互冲突的诸权利协调与博弈过程中的矛盾反映,暴露出中国网络隐私权、网络名誉权保护制度与互联网侵权救济制度的不足。互联网技术及日益发达的讨论性社区为人肉搜索提供了技术基础和虚拟社会基础,法治框架所要提供的则是它所需要的法律基础。对人肉搜索进行价值分析将指引着人肉搜索法治维度的建立和完善。

| Abstract: | The discussions and comments at present in China on the phenomenon of cyber manhunt through internet show the conflict between the openness of internet information and the protection of citizens’ right of privacy under network environment,lay bare the contradiction of many conflicting rights and interests,and reveal the deficiency of protection system for citizens’ network privacy and network reputation right and the deficiency of remedy system for the internet tort.The expansion of discussion areas in internet provides a technical base for cyber manhunt while the law requires the legal deed in doing so.The analysis of the value of cyber manhunt will benefit the perfection of legal system of China and help legislative institution determine which is to protect in legislative process,maintenance of internet order or protection of citizens’ right of privacy. |
