| 摘 要： | 省级开放大学存在多重委托代理关系，委托代理主体与大学章程制定主体在利益与权益上具有一致性，同时其价值取向和利益诉求相同。委托代理主体参与大学章程制定有利于规避行动风险和信息隐藏风险，强化隐性契约的约束力，降低委托代理成本。根据权能和利益的相关程度，委托代理方参与章程制定可分为决策主体和影响主体。

| Abstract: | Provincial open university possesses multilevel principal-agent relationships. Both subject of principal-agent and making subject of university statute have the same interests and rights, their value orientation and appeal are also equal. The subject of principal-agent in making statute is good for risks free and information hiding; meanwhile it can strengthen the restraint of implicit contract and decrease the cost of principal-agent. According to the degree of correlation of power and interest, the participation subject for two parts can be classified into decision subject and influence subject. |
