| 摘 要： | 犯罪分层是指根据犯罪的严重程度将所有犯罪划分为不同层次的犯罪分类方法。犯罪分层理论既有刑事法上的意义,又有刑事政策上的意义;既有刑事实体法的积极意义,又有刑事程序法与刑事执行法上的积极功能。世界大多数国家刑法典采用犯罪分层的做法,但是,犯罪分层无论是我国刑事立法还是刑事法理论研究,尚处于未知领域。为此,我们欲通过对世界各国犯罪分层实践的现实考量,分析我国犯罪分层理论展开的必要性,在此基础上,探索性提出我国犯罪分层理论框架。
