| 摘 要： | 随着我国市场规模的扩大、国际分工的深化.以全球跨国公司为主的专利权人及其联盟,积极转变方式,并沿着从产品市场转向知识产权市场、生产环节转向销售环节、整体推进到重点突破的路径加大在华维权的力度.我国企业由于缺乏自主知识产权、销售渠道等优势,在应对专利权人过度权利主张时与专利权联盟、渠道商进行利益博弈时,总体处于被动的地位,必须采取有效措施积极应对,确保我国战略利益的实现.
