| 摘 要： | 在刑法理论上,可以将犯罪形态分为作为犯和不作为犯,而不作为犯又可分为纯正的不作为犯与不纯正不作为犯。就纯正不作为犯而言,刑法往往明确规定了作为义务的主体与内容;就不纯正不作为犯而言,刑法则对此未加以明确的规定。本文从不纯正不作为犯的形式作为义务的来源、实质作为义务的来源以及作为义务来源之重构几个方面对不纯正不作为犯之作为义务进行探究,以期有裨于理论与实践。

| Abstract: | In criminal law theory,patterns of crime can be further divided into crime and negative crime,and negative crime can be divided into pure and impure negative crime.In the negative crime,as far as the pure negative crime,criminal law is defined as a subject and content of the obligation.As far as the impure negative crime,criminal law is not to be clearly defined to this.This article explores the obligations of impure negative crime,from the form,substance and reconstruction of the obligation source,with a view to the award in theory and practice. |
