| 摘 要： | 非法传销作为一种资本运作方式,几乎与合法的直销行为相时而生,如何正确认识非法传销的本质,如何充分发挥政府在调整经济运作方式、规范社会秩序中的作用,是当前面临的现实课题.文章拟从传销与相关概念的关系理清,现行法律对非法传销的刑法规定等方面展开分析,提出政府在规制非法传销中的责任,以深层次、多维度举措加强时非法传销的打击力度,切实维护正常经济秩序,构建社会主义和谐社会.

| Abstract: | As a way of capital operation,Illegal pyramid schemes were born with legal direct schemes almost simultaneously.It is nesessary to recognize the nature of the illegal pyramid schemes,and give full play to the government in the adjustment of economic operation mode and regulate the function of social order.The present paper aims to define the relationship of pyramid scheme and relevant concept,analysis the criminal law about illegal pyramid schemes,and proposes government’s responsibility for the regulation of illegal pyramid scheme.In a variety of measures to strengthen efforts to combat illegal pyramid schemes,safeguard the normal economic order,and build a harmonious socialist society. |
