| 摘 要： | 混合法庭是西方列强实现其在近代中国享有的领事裁判权的重要方式之一。上海公共租界混合法庭作为近代中国混合法庭的典型,采用了当时中国衙门的组织形式和西方的诉讼模式,法庭由缺乏法律专门知识和司法经验的陪审官主导审判,它的发展与外人的不断扩权相始终,中国传统法律难于在混合法庭适用。上海公共租界混合法庭作为特定历史条件下的产物,一方面侵犯了中国的国家主权,另一方面客观上促进了中国的司法进步,加快了中国法制近代化的进程。

| Abstract: | The International Mixed Court was an important place where the consular jurisdiction system of the western imperialist powers ran in modern China.As the most typical one of mixed courts in modern China,the International Mixed Court of Shanghai adopted the organic form of Chinese yamen and the western procedure of the court.Assessors who lacked the specialized knowledgeand judicial experience predominated in the court.The development of the Mixed Court was accompanied by the expansion of power of outsiders.Traditional Chinese law was not applied in the Mixed Court.As the result under specific historical condition,on the one hand,the Mixed Court infringed the judicial sovereignty of China;on the other hand,it helped with the modernity of Chinese legal system. |
