| 摘 要： | 较之于结果加重犯,加重构成犯有其独立的犯罪构成,其主观罪过要求具有重大过失。将间接故意和过于自信的过失合并为重大过失引入加重构成犯的罪过形式中,并排除疏忽大意过失构成加重构成犯的可能,有利于实现罪刑相当,限制加重构成犯的适用。

| Abstract: | compared to the aggregated consequential crime,the aggregated crime has independent constitutive elements of crime,and its subjective fault needs culpable negligence.The culpable negligence includes indirect intention and being excessively confident,which has been introduced into the offence forms of aggregated crime.It eliminates careless and inadvertent negligence ,which is helpful to realize the measurement equality of penalty, and restricts the application of aggregated crime. |
