| 摘 要： | 在我国已经基本确立了当事人主导的民事诉讼体制的前提下，通过法官释明权制度的构建来更好地为实现公民诉权而服务也就戍了大势所趋，应该从行使原则、适用范围以及行使方式等方面来逐一完善立法。

| Abstract: | The fundamental aim of judge interpretation is to protect civil right of action to the flail realization. With the rapid transformation of China＇s lawsuit system, the establishment of interpretation system has also become an urgency. Improving legislation should be accomplished by three aspects：exertion rules, applied scope and exertion methods. |
