| 摘 要： | 高校学生伤害事故中学校的法律责任认定在实践中易生纠纷。本文通过梳理教育机构赔偿责任的法律依据对学生伤害事故进行界定，对高校在学生事故中所负责任性质及高校对学生的教育、管理、保护责任予以明确，在此基础上分析了高校学生伤害事故的归责原则及校方无责任类型。以助正确界定高校在学生伤亡事故中的法律责任。

| Abstract: | Conflicts are easily resulted in the decision of legal liabilities in student injury accidents in colleges and universities. Through a study about the legal basis of compensation duties of education institutions, the article defines student injury accidents and elaborates the nature of the liabilities that colleges and universities should bear as well as the responsibility of education, management and protection. Furthermore, it analyzes the principles of liability fixation and the irresponsibility categories on the part of universities so as to help the correct definition for legal liabilities of colleges and universities in these accidents. |
