| 摘 要： | 我国的夫妻财产制度还存在着诸如共同财产的范围宽泛,知识产权的期待收益规定不明确,财产权利的形式单一,夫妻分居期间的财产归属规定不合理,财产约定的程序不健全等问题。建议我国今后的婚姻立法将夫妻一方继承或者受赠的财产原则上规定为个人所有,明确知识产权期待收益的具体归属,构建夫妻分居期间的财产归属,建立夫妻无形财产和财产约定申报登记制度等。

| Abstract: | Marital property system in China has many deficiencies such as common property in a wide range,vagueness in provisions of intellectual property rights of the expected benefit,a single form in property rights,the unreasonable regulations of property ownership during separation,the unsoundness in agreed property procedure.The proposal is that the future marriage legislation should make one of the spouses inherit or donate property as individuals in principle,define specific attribution of intellectual property rights of the expected benefit,construct the ownership of property during separation,establish the system of intangible assets and property declaration between husband and wife. |
