| 摘 要： | 无法通过强制实际履行的合同,一旦出现一方拒绝履行的情况,其解除在所难免。《合同法》第94条“有权解除合同”的“当事人”应理解为“合同各方当事人”,如此,并不必然损害交易安全;相反,更为节省社会资源,也更为实际。

| Abstract: | A contract,impossible to be carried out by coercive measures,has to be terminated when a party refuses to fulfill its obligatoins. The term "the person concerned who has the right to terminate a contract"in the 94~(th)provision of Contract Law of China should be interpreted as "the respective parties concerned in the contract ".Therfore,it does not necessarily harm the safety of the transaction.On the contrary,it is more economical with social resources and more practical. |
