| 摘 要： | P2P技术的发展为文化的传播及创作提供了便利，但这一技术引发的信息网络传播权侵权问题也日益突出。世界各国对于这一问题的态度也各有不同，本文对中国和美国在该方面的立法及司法现状进行比较，分析它们的差异，并总结产生此差异的原因。

Countries in the world have different attitudes toward this issue. This paper aims to make a comparison between Chinese and American legislation and judicial practice in this field, point out their differences and summarize reasons behind them. |
